Under 29 CFR 1926.51(c)(1), OSHA requires that toilets must be available for employees at construction job sites to ensure that workers will not be at risk for experiencing any health conditions that can arise if facilities are not available for use. OSHA’s standard specifies that there must be at least one bathroom for 20 or fewer employees.
If 20 or more employees are employed at a job site, there must be one toilet seat and one urinal for each 40 workers. For job sites with 200 or more employees, one toilet seat and one urinal must be available for each 50 workers.
OSHA also stipulates that if a toilet is not easy to get to, it is not considered to be available and would not count among the number of available and provided portable bathroom units. The aforementioned standard is in place in part so that those providing portable restroom units for employees at job sites also take into account the necessity of being able to access a restroom in a timely manner, in turn reducing the risk of unsafe health conditions.
In addition, OSHA explains that toilets that are not sanitary and therefore cannot be used do not qualify as available restroom units.
An employer can ensure that they are providing portable restroom units that are appropriately sanitary by consulting OSHA’s ANSI Z4.3-1995, Section 3 (“For Sanitation — Nonsewered Waste-Disposal Systems — Minimum Requirements”).
